Question about In-laws help

    Question about In-laws help

    My in-laws wahnt to help us out a bit.
    They want to open a checking account in their name only, but have my husband a signer on the account.
    We have filed chapter 7 but have not had our 341 yet.
    I am not sure we should do this. Just need some input about this.

    If your husband becomes a signer on the account, technically he would need to disclose this to the trustee. I know things are hard right now, but you already filed, so it's a matter of a short time until your 341. Hold until after, if you get a report of no distribution then you should be ok.

      I agree with ccsjoe that you should wait until discharge to open the joint account. If you need some assistance from your inlaws, perhaps they can pay some of your living expenses directly. This would not have to be brought up to the trustee post filing.

        Both above are right on. PLEASE do not take gifts at this time. It is income and could cause you a failed or delayed discharge. Take no money in hand, and let them "help" you by indirect payment. Trust me, I have made these mistakes and name one and we screwed it up. We got by as our Trustee as well as the Judge could see our ignorance. We soon learned by payment of 10.5K that would have been unnecessary if we had known what we were doing. You just got three good advices. Take NO help at this time. 'Hub

          Thanks for your input. Just have to be a bit more patient. It's hard not knowing and having to do a lot of waiting.
