    NJ chapter 7

    i am going to file chapter 7 here in NJ next week... have about $15,000 in CC debt all with collections or lawyers and my car payment which is current at about $10,000 i have no assets and rent... i rent a room with a roomate and dont own anything other then my plasma tv and bed... my roommate as a few things around the apt. what do i have to do about that? and i am also single and WELL under the median income in this crap state.

    also have another question, Trenton is a far drive for me, can i mail this petition?

    i am planning to use USAbankruptcyassociates to get the paper work done quickly

    also Capital one/ pressler and pressler are sueing and the 35 days just past past week... i called the court today and they have not yet gotten a judgement... i am filling my papers hopefully tuesday so i am just putting that they are sueing at the time i file... and i will contact the Pressler and Pressler law office when i do file with some type of BK number so they dont try to levy my bank account

      Before you pay anything to that document service, do a search on them. I've read a LOT of negative reviews about them. Such as not getting the paperwork right, in fact so wrong that the discharge was denied. I previously gave them serious consideration--UNTIL I read those reviews.

        USAbankruptcyassociates....no phone, no address, no listing w/ BBB, and a rash of ripoff reports across the internet...I would be careful....

        You need the BK notice which will have the case # and file date. You file the BK notice with the court where you are being sued.

        Yes, you can mail your petition to the court....but before you do, you should go to the BK court website and find the list of forms needed for a complete filing. Cross check this w/ your petition.

        Have you taken a credit management class? Before you can file BK, you have to complete a class from the list of approved agencies on the BK court website and have a certificate to include w/ your filing.

        Do you know about the NOLO book? Very valuable resource for pro-se filers www.nolo.com

          thanks guys, yes i did the credit counseling and got the certificate.... i am going to do the debetor education class after i file and am not sure if i want to keep this car payment so i will be doing the reafirmation after i file as well... after reading alot about those petition filers i am going to go with Bridgeport to prepare my bankruptcy... like most of us i can not afford a lawyer so this is my best route

            Glad you didn't get taken by USBkAsc, does Bridgeport have a good BBB rating?

            If you are filing pro-se, you really should get the NOLO book, it has step-by-step instructions, folks on the forum rave about it.

            And be sure to get the court list of documents required and the order to have them in before you send it off. Formatting of the creditors matrix was a critical issue in our court. You can assume Bridgeport will do it right, but I would double-check.

              When I was looking for a preparer, I also read similar reviews about Bridgeport. I was not able to find any reputable ones. Maybe a call to the local bar association would help? Maybe they could suggest a good one. I think one of the biggest problems with all the doc prep companies I read about was that they weren't local--their docs just weren't right for the district they were being filed in. I never thought to call the bar assoc! I think I'll call mine on Monday!

              Depending on how low your income is, maybe you'd qualify for help from the local legal aid?
