Originally posted by ccsjoe View PostSo, you did all your homework, went and observed some 341's with your trustee, feel you got a good handle on everything, review all papers night before, everything good right? So what would constitute your Halloween setting for your 341?
For me, it was getting off the elevator and hearing my trustee yelling at a debtor that is she interrupts him again he will continue the meeting for at least two weeks and she will only be admitted under doctor's evidence of medication.
Next case, trustee yelling at attorney who previously continued a case twice for two months to fill out schedules properly and still got them wrong, then telling the poor debtor that they better get some of their 3600 fee back (CH7, ridiculous fee).
This was followed by a gentleman from Mexico who filed CH7 joint, but wife wasn't allowed in the building because she did not have documentation other than her passport with no US entry stamp. Fortunately (really, fortunately???) the UST was present and kindly offered to go downstairs and escort her in provided she had her passport. OMG who was she present for?
Next up...oh yeah, li'l ole me...cr@p! And the UST had made her way back into the room already...dangit! Is she here for me?...get ready to rumble!!!! My wife didn't realize the significance of the UST presence until she felt me tense up and whisper at her. So yeah I get up and our trustee looks at me, looks at the file, then addresses me by name telling me "nice to see you again Mr. X". Cr@p again, he remembered me from two weeks ago when I sat through 2 hours of his 341's and got in the same elevator with him! On the plus side, I was the only debtor he exchanged pleasantries and jokes with.
After all that buildup....75 seconds of standard questioning followed by...."you're excused, thank you, nice to see you again Mr. X."
In other words, in and out in 75 seconds, total breeze!!
Howdy fellow 60 day'ers"I DECLARE BANKRUPTCY!" Ch 7 Filed 7/15/11 * 3 Minute 341 8/19/11 * Discharged 10/20/11

Wow. $3600 fee for chapter 7 and didn't get the job done right. Overpriced and under-worked. Am I judgmental? At the law firm I hired my lawyer, they would charge only around $2800 to $3000 for a chapter 13. That's what I heard.
Anyway, good to hear it was smooth for you Joe.Filed chapter 7 Jul 13, 2010 341 hearing Aug 12, 2010 Trustee's report of no distribution Aug 20, 2010 Discharged Oct 13, 2010 Closed Oct 28, 2010.

Congrats ccsjoe! Remember my breeze of a 341? Well.... today Pacer reports "Trustees initial report. The trustee of this estate reports that the meeting of creditors was concluded and the trustee is investigating the existence and location of property of the estate not subject to exemptions or security interests." What???? I only thought I could breathe again! I would love some ideas.
