    garnishing wages

    Morning, I have a question about wage garnishment. I have not yet filed and just received a letter from my work that my wages are going to be garnished, I am unable to afford to pay for an attorney just yet, but if i put some money to retain a lawyer will they be able to stop this before i get a case number?

    there are many atty's who take payments...

    i suggest that you get a "free" consult asap to attempt to see what can be done about the wage garnish. each state is different in the handling of this type of situation...so maybe someone from nebraska may know more details...however, in the meantime i would immediately be seeking an atty.

      I was told by my attorney that until I actually file they can't stop a wage garnishment. You can let the creditor know your intent to file, that might hold them off. You can also notify your employer that you are going to file soon and they might not enforce the wage garnishment request.

          Sorry, but you must file to stop garnishment. Also, the attorney must be fully paid before he/she files your petition. Maybe you can sway the attorney a bit to file before full payment. As tobee said, try to find an attorney as fast as possible.
          Filed August 20 341 on September 23 Report of No Distribution - September 24 Case Discharged and Closed on November 23!!!

            We are in the same boat. We have ridden it out until now for over 2 years. The best thing to do is what the previous poster said. Talk to an attorney and talk to your HR department and tell them of your intent to file. They would only be able to hold off a few days, so I would start working on the attorney thing right now, as it takes some time foran attorney to get all of your paperwork together. Good luck

              You may file yourself. You are not required to use an attorney.

                To the PP, if the OP is looking to get out of a garnishment fast, an attorney would be the way to go. I could never have filed Pro Se in the time frame I have (2 weeks) and my garnishment is coming. If it takes my attorney 2 weeks for paper work, it would take me at least 4. I was just explaining the quickest and easiest way to stop the garnishment.

                  while that is absolutely true....when you have situations such as garnishes etc., it's really not always wisest to go it alone. if it were cut and dry..i'd say go for the pro se.

                  not that it's can't be done. however, even tho i was in the legal field i wouldn't even consider it. "he whom represents himself has a fool for a client" as the old adage goes...but that's completely an individual and personal decision.
