    Messed up debtor education class

    today is day 48 from 341. Completely forgot to complete debt management course (haven't had internet). Quickly completed course tonight and will deliver to my attorney first thing. Are we out of luck? Our sixty days isn't until October 4.

    Form 23, certifying that you participated in the financial management class, is supposed to be filed with the court no later than 45 day after the first date set for your 341. All you can do at this point is get your class verification to your attorney ASAP. Have you checked Pacer to see if the court has taken any action on your case? The court can close your case without a discharge for not filing this certificate within 45 days of your creditor meeting.

    Out of curiosity, did your attorney follow up with you at all in that 45-day time frame?

      No, I have not heard a word from him since our 341 meeting. I looked through all of our paperwork, and NOTHING has a mention of this class or a deadline. I know he mentioned it early on, and I simply forgot. No excuses.

        Well, get the certificate over to your attorney as soon as you possibly can and make sure the office knows that it's past the 45-day deadline and that it needs to be filed immediately. It's possible that you may fly under the court's radar if you get it filed before they take any action on it.

        We all make mistakes and forget things from time to time. Don't beat yourself up about it, what's done is done and you can't change it. Just make sure that certificate gets in the court's file PRONTO!

          Already emailed it at 5:00 am this morning, and left messages with attorney. If he can't file it today, I will.

            At the time of your completion, they didn't give you the option to send it to your attorney directly? At my jurisdiction, they only accept it if the certificate is sent directly to the attorney and the attorney will file it with the court. Anyway, good luck. Don't stretch too much, hope everything will be fine.

              No, it didn't, but I sent it directly to him anyway. If I have to pay extra filing fees, I will, it's my responsibility. I hope you mean "don't STRESS too much"

                You're welcome. Sorry if I made you misunderstand. I guess probably I used the wrong term. I used to say stretch in stead of stress an nobody corrected me. You're the first one.

                  I kind of like stretch . Maybe I'll start using that!

                  Anyway, thanks wnguyen & cupcake for your kind words. My attorney just emailed me, he took the certficates down at 9:00 am and filed them with the proper form. He apologized, and said we were fine since the case was still open. I feel much better. This case has been going so well, and I really didn't want to mess up now!

                  DON'T PROCRASTINATE (or forget)!!! Get it done ASAP!
