    UST 10 Day Timeline?

    Well, its been pretty uneventful so far. Filed, got letter from the UST asking for more info (Bank statements, Utility bill copies etc). I had my 341 on 09/08 and checked PACER today and nothing. My understanding is that if the UST had an issue, he would have had to file within 10 days of my 341. Am I correct? If that's the case, would it be fair to say I am just waiting out my remaining 48 days to discharge? What other concerns should I be looking for? Had not used any credit since 2008 so the creditors will not have any claims......

    Hi nfreeze,

    Don't forget your financial management class, the certificate needs to be filed w/ the court within 45 days of the 341.

    Congrats on the smooth run so far, hope the rest goes just as well!

    ps: I am pretty sure the UST has 30 days, but hopefully you never hear from them again...

      Hello TC- Course completed. I have a reaffirmation hearing on my vehicle on the 26th so I will file that while I am at the courthouse. Somewhere I thought I read the UST has 10 days from the 341 to file a MTD or POA and then has 30 days to notify the creditors of such? For now, I will just enjoy the "Quiet" times I guess... lol

        Sounds like a plan nfreeze,

        Just remember that if the reaffirmation is not court approved, you can still stay current and stay in the vehicle 99.9% of the time.

        Also we want to be glad we aren't the folks from Montana whose UST has filed almost a years worth of time extensions......

          In theory the UST has 10 days to file an objection under 707(b) but has until the day of discharge to object for other reasons, almost the same reasons.

            Yes, 10 days post 341 to file presumption of abuse. Our US trustee filed it on day 9. Now thay have 30 days from that filing to file motion to dismiss or convert the case. Our 30 days expires on Monday and we have not heard a word from the US trustees office since we updated our means and schedules.

            Holding my breath for 5 more days.
