Discharged!!!!!

      I don't want to burst anyone's bubble, congratulations for sure, however...my boyfriend was discharged (no asset consumer, small business dissolved, Chapt 7 filing) on 7-12-10, but the case still hasn't been "closed" and I've been told that's what we NEED to wait for. I'm in Texas and I can tell you after realizing that the Trustee can "look back" for as long as 2 years if he wishes, they filed an application to employ counsel (albeit a day after the deadline imposed for additional documentation [statements, etc. back 4-5 more months], and the judge finally signs the order granting them same a month after. Technicalities, but I'm surprised. He has a lawyer, but he's not the best 'out there' for sure and I work for lawyers, just not bankruptcy. We are confident that the additional documentation provided (a little more than they requested) shows it was all business related, nothing luxury related; and every statement shows more checks written than he had money in the account...hence, constantly over-drafted for pretty much the last 1.5 years or more. Still, we're in LIMBO waiting to see if they request "additional" information or, finally close the case. Until we see that "closed" status on pacer (which now states "awaiting closing"), we aren't ready to celebrate. Although, even after that, he still has the IRS and ex-wife payment from divorce settlement (not discharged) to deal with. Still, we are counting our blessings and me and his family have been there throughout the long road. What upsets me more than anything is, the word "compassion" is far removed from the "bankruptcy" dictionary as I watch what he has gone through, as I'm sure SO many of you have.

      BUT, please don't let this take away from the DISCHARGE celebration - I just wanted to point out that 'CLOSING' is what we're looking for.
      Boyfriend filed: 3/31/10, discharged: 7/12/10 - STILL awaiting closing. I pray for miracles every day. Compassion should be found in the dictionary under "Bankruptcy", sadly, it's not!

              both ours came in one day in the same envelope...the discharge and the trustee's no asset distribution order releasing the estate.

              yes, i have seen when there is a discharge, yet the trustee hasn't let go yet.

              from what i have been reading our situation of rec'ing them both at the same time is more unusual that getting them even at times a month or more apart.
