    Thank God I'm really broke! The only larger amount I might obtain after filing is a lottery win - and that would be mine to keep!
    Filed CH7 9/24/2010, 341 on 10/28/2010, Disch.&Closed: 1/6/2011. FICO EX: 9/2: 672.
    FICO EQ: pre-filing: 573, After BK Public Record: 568, 10/3: 673.

      Actually, she did say when it was filed. Read her initial post. She filed in May and was discharged last week.

      You can dance around this all you like but, that inheritence is property of the bk estate.
      Doesn't matter if she knew about it at the time of filing or not.
      you know i see that may date...and it just couldn't click ....discharged so quickly...unless this was such an in and out case it's hard to believe it went well...but who knows...certainly not i. and if it was that OP most likely had a low no asset case...but that's purely speculation.

        1. people just never report it - true but get caught, lose discharge & maybe go to jail.


        jail...could be appealing...3 meals no clothes to purchase..no rent..could work


        2. even when they do, it may not be worth the courts effort to retrieve the amount involved. Always possible then the Trustee will abandon the asset.

        that is what i think is the case here although purely speculation.


        3. there is perhaps no current case under the new federal bankruptcy laws settled as of this date. Nope - totally wrong. This portion of the Code is the same today as it was when I started in the late 1980's Read on. . .

        i did...and now you have found me out.... you know...4 years at bu.... i hated family law and bankruptcy law...you got me...you win. (i did get excellent grades...really...but they were absolutely my least favorite type of law).

        no info overload is appreciated, informative and helpful.


        however, i stand firm...i would not report it unless it feel clearly into the was 180 day situation. but that's just me.

        (and i got a A in ethics...) LOL!!

          me too!!! so i have nothing to worry about either...unless i have some unknown relative somewhere that has left me a few mil....

            I was not going to add to this thread but when I saw the above I just had to respond. . .

            Not yours to keep if you happened to buy the lottery ticket the day before you file. . .

                My case didn't have much of anything to contest. Divorced, no assets, and unemployed. I was suprised though it went that quick. My lawyer said 6 months. Don't mean to create a larger argument, but i read online that legally theres no law that says i have to accept the inheritance. I have no idea if thats true. But if its a small amount, why not just say i don't want it. Regardless, I'm going to talk to my attorney, and probably the attorney handling the inheritance tomorrow.

                  that was my take on it. good idea...just run it by your atty....and see if you don't have to accept it and give it all to your mom or something....i do know in some states you can transfer...however your atty will know what's the best way to work with or around the situation for your best interest.

                    That ain't gonna happen. I always buy AND check the ticket on the day of the draw. I'm going to file on Friday - my birthday . In case I win Wednesday..no need to file.
