I'm speechless. HHM sums up the points I probably would have made. Additionally, I would seek to disgorge the attorney's fee or hire an attorney that will implead the former attorney as a defendant. That should really get interesting and I'd love to be there to watch the trial!

I'm wondering what the judge will say at the hearing. It's quite obvious to anyone who is familiar with bk that you don't charge anything for 90 days prior to filing and it's BLATANTLY obvious that you don't charge your attorney's fees. It sounds like she scammed you and I would wonder how many others she may have done this to. Do you know anyone else who has used her? Is she really an attorney?
Then again I'd have to wonder how she would even get away with it and if it's worth all of the hassle.
Anyhow I would imagine the judge would see very clearly that this is highly suspect. I am very interested to hear how this will turn out...

I remember this case, and am still dismayed by this attorney. Many have commented on the fact that an attorney accepting credit card payment for a bankruptcy case is the epitome of malpractice - if us as lay people know this, then the attorney HAD to have known it.
And now she is refusing to help? Geez - it sounds to me like she needs to be disbarred.Filed: 6/30/2010

well depending on the state most bar assoc. will give her a tiny nudge on her fingertips if the OP is lucky.
if you ever get the opportunity to sit in on a dispute...the panel is made up of the atty's piers...usually he or she knows one or two...maybe there's a citizen sitting on the panel...but they usally are related to someone else sitting next to them. it's a joke and a shame.
i have sat in on at least 3 and really they did nothing to these atty's that were terrible...one was a billing issue...clearly an overcharge on the billable hours..terrible and they sided with the atty. remember law is not justice and justice is NOT law...it's sad but true.
