Our 341 is tomorrow. My mother-in-law had a stroke today and is not expected to live

    ....your sorrow/grieving at the pending loss of a love one, ...or the important financial implications of such?

      More questions.

      Since my husband is the one named in the will, would the trustee distribute his debts or ours jointly. My business is the main reason we are doing this.
      Some of the debt is for my closed S-Corp, and we will only be discharged personally, the business will retain the debt. I wonder if that will be exempt from the disbursement.

      My poor lawyer. She is really good. I know she didn't expect such a complicated client. As of two days ago, we were an easy, no asset Chapter 7.

      Interesting development. My sister in law is an estate attorney. ( Husband's brother's wife) She set everything up. The estate (will - whatever) is set up as a trust.
      There is probably a spendtrift clause. She is going to check and see what she can do..she has power of attorney etc.

      Thank you so much LSUTiger and ccsjoe and others who repsonded. I just got back from the hospital and I wanted to jump right back and say how bad that post made me feel.
      She is 86 years old. We love her dearly.

      FWIW.. the trustee did not ask anything about inheritance. Just very cut and dried questions and two or three minor questions about my defunct business.
      I hugged our lawyer after it was over. We will deal with what comes our way after things are settled down.

            So sorry to hear of your MIL's stroke and having to wait for the inevitable. God bless her for living to be 86 yr. old! I lost my dear cousin in June to a stroke, she was like my sister, and only 56 yr. old. Strokes are devastating, blessings to you and your family. Glad your 341 is done and you can concentrate on your family and grieving when it's time.

              You and your family are in our thoughts and prayers. So sorry you have to deal with BK when your heart must surely be with MIL, husband and other loved ones. Congratulations on getting through your 341 mtg. It must have been very difficult. Keep us posted.

                My kind thoughts and sympathy go out to the OP. The inheritance money is recoverable by the trustee however, if your husband receives it within 180 days of filing.

                    Still stand by my post..... The post by the OP appeared that she was more concerned about whether a trustee could claim a potential inheritance, than her MIL's devastating stroke and imminent passing. The rest of you should be ashamed of yourselves....

                          Mr. Wang: Apparently you have never lost a loved one close to you. If you have, (such as a Mother with no one else but you) the first thing you realize is "Mom's gone". Then sir, the coroner calls you, and states this fact and what to do with the 'body'. Then you in shock as the hospital she was taken to wants the gurney back. Then you call at night and wait for some stranger to address you at a funeral home, explain the charges and to where to take her.

                          Then the next morning if you sleep at all, you visit the mortuary, of course she died indigent so who will pay? Make payment arraignments, of burial or cremation. All this time thinking, who the hell do I contact to tell? Then you get a final OK to bury or burn her. The payment plan flies. Of course you cannot afford this payment, but you must do so. So you give the OK to do what is needed.

                          Day two, she is layed out in this wood cheap box with a liner instead of vault due to the price. Then you see her with a smile and makeup. Never looked so good, so you weep a bit but onward to home to make many calls. Then to her house before the neighbors find out, and the place is ransacked.

                          This Mr. Wang, is business in spite of Mom passing away. It actually happened to me and is a true story. Now, did I have time to grieve? Well hell yes I did and not only that I was mad as hell for having to do all that. Not at her, just angry as hell for no reason but what I HAD to do without warning. But it had to be handled.

                          These folks are in BANKRUPTCY, which means that they are already under stress, pressure and grief.

                          You sir, come about with your ever judgmental, puritanical, better than thou opinion, that they should be on their knees in front of a coffin praying for a person just about to pass, when they are doing the responsible thing of handling the affairs at hand. Shakespeare wrote: "To thine own self be true". That has more sense than your curt opinion at a time when you would do best to aid, than judge or post nothing at all.

                            Actually "Tig" you are right. I just could not contain myself. Call it catharsis for myself. If this jerk is a "Troll" or stit stirrer, he will be found out soon enough, and banned. To date since the site has recovered and still in repair mode, I have seen three bans from jerks attempting to filter spam and one possibly targeting some malware. I am not sure but I think the site was brought down by a hacker. I analyzed the body and the server was up. I ran a chat room and am familiar with attacks.                               This is the internet and I could give a rats @$$ of what others think of my internet persona...... to Angelina.... Get of your high horse..... To the others and judging by their responses, I am quite sure they would be chomping at the bit to get their grubby little hands on their relative's estate if they were in the same situation....
