    Chapter 7 help

    Please Help. My husband and I are new to this. We are married with 3 children and live in Tennessee. We went to a lawyer, took them all the stuff they asked for and were told they would call us within a week and not to pay anything until we heard back. After a week of waiting the only phone call we had was from the secretary wanting the vin numbers of our vehicles. The following Monday, we were going to call back to demand answers. I unfortunatly had an auto accident in one of the vehicles we were filing on, on the way to work. Was notified today that it was a total loss. The payoff was $7,400, insurance paying $6052, leaving aroung $1,348 owed to the creditor. I then called the lawyers office back to let them know this and asked if this would have an effect on our bankruptcy. The secretary said no, but would need to wait until the dust settles (whatever that means). Our income just around $900 under the median test. The secretary says we passed the median and the means, but we still cant file this week. From my calculations since we are only going to keep our house (payment $315), we failed the means test. I am worried that the lawyers office has miscalculated and we will look like idiots when we go to the 341 meeting. Also, because of all their himhauling around we are getting further and further behind with every creditor calling. My husband is also concerned of the fact that some of his personal loans will be paid off within 6 months. Does the trustee look at the time you owe on the loans? All of our creditors with the exception of the house will be paid off with about 3 1/2 years.

    The first step in filing for a chapter 7 bankruptcy case is to file a petition with the bankruptcy court in the district where the individual lives or where the business debtor has its primary place of business or its assets. The debtor is required to file schedules of assets and liabilities, including current income and expenses, and a statement of financial dealings. A married couple may file a joint petition and pay one filling fee, or a spouse may choose to file individually.

      Have you paid your attorney in full yet? He probably won't file until he's paid in full.

      When the forms are all filled out, go over them carefully and get any questions you have answered before you sign the bankruptcy petition.

      It doesn't matter what day this month you file, all the calculations are the same whether you file today or on the last day of this month.

      If you can't take the phone calls, consider changing your phone number(s) and only giving them out to relatives and close friends.
