    trustee wants my tax return results

    I just wanted to let everyone who is wondering about the end result of trustee wanting a tax refund. We sent him our tax return and we recieved the letter telling us what they wanted. He wants 75% of our refund (state and fed). this is exactly the percentage when you take the date we
    filed/365. My child tax credit was larger than this amount. So beware that Child tax credits and EIC are NOT safe. They want it all. On top of that, he also asked for the $50 cash on hand and the $50 that we had in our checking on the day that we filed. I hope that trustee sleeps better knowing that he took what was my last $100. I can't believe how greedy they are!! I wonder if they would like to take my baby's food and sell it too!! (I'm really bitter)

    That does seem petty. I guess your state doesn't have any exemption for this? Did you claim a homestead? Usually your cash exemptions are less when claiming homesteads but $100 seems very petty. I hope they all pick a winner with it. Best of luck.

      Something is not right here, if you filed correctly or used an attorney, I can't see how they would take your only $100 in cash.

        Wow that is harsh....and rather surprising? Where do you live??

        here in Illinois it says....



        Did you not have ANY exemptions left?? No wildcard? or anything?...Your lawyer (if you used one) should have been able to exempt at LEAST the $100!

        Our trustee didn't want our Tax refund ($4600) or our $200 (in bank).

          Wow, that's harsh!!

          I know in Fla, you only get $1000 per person and a total of $2000 (for joint BK) in exemptions. TOTAL. That has to include everything in your house (we had to list our washer/dryer and I think our frig) such as couches, all clothes, kids furniture, DH's military clothing, etc. So, for us, it was easy to run out of the exemption. PLUS that includes any "cash on hand" too. I know we have nothing left over, and are in hot water right now w/ the trustee for "undervaluing" our belongings.

          As for EIC, I thought that might be exempt too. I know in the CH13 I listened to the trustee said to turn over their refunds minus the EIC.

          Our atty told us the trustee would take the % of when we filed for the year. We filed in Oct, so the trustee gets 10/12th of our refund.

          I'd find out for sure about the EIC!!

            We were not eligible for EIC, but were for Child tax credit. We live in Kansas and my friend had to hand over 75%, which included EIC and the child tax credit. I used a lawyer and will call him first thing monday morning. I thought we could have up to $100, but I guess not. So in Kansas, EIC and Child tax credits are being taken. I hope all states are not like this. We like many others could have used this money to try to get ahead. I guess the joke's on them because my daughter still has her piggy bank with at least ten dollars in it!!

              in florida there is a $1,000 exemption for auto, head of household wages of $500 per week for six months in a bank account, and household property of $1000 ( for each of you). no offense, but if your attorney did not know this, you got screwed big time. I'd sue him.
