    Case still not closed...should I ask the TT?

    We have been discharged for over 1 year.
    We were an asset case in which we agreed to "buy back" our non exempt assets from the estate. We sent the last payment to the TT this past July.

    On Pacer, there has been nothing filed since May and that was an interim report.

    Should I ask the TT about the case getting closed or just ride it out longer?

    We are renting a house and have the chance to buy it at a really "to good to pass up" price with private financing, (owner financed).

    Would buying the house and recording the deed be detrimental to our ch7 case?

    Hi roozterdvx,

    Lots of folks seem to be having delays, apparently just administrative delay on the courts part. Someone got good results by calling the court clerk and politely inquiring.

    I say go for the owner-financed, that is what we did. Couple guys locally carry the note, we met a local restaurant to sign papers, great experience,

    As far as I know there is no law about getting a house between discharge and case closed...

      You made your last payment to the Trustee a 2 months ago. It will take the Trustee months before he can distribute the $$. He has to file a report with the UST. The UST has to approve his report. He then has to file a Notice of Proposed Distribution with the Court and wait, I believe 15 or 20 days for any objections. If he hired an attorney to help in the case he has to file an Application to Approve payment of the legal fees. Once everything is approved he has to send out checks. He then has to wait for all of the checks to be cashed. He then has to do a final report and accounting. In other words there is a ton of stuff that must be done before he can close the case. Calling him is not going to speed up the process.

      As to purchasing a home: You have your Discharge. The closing of your case does not affect you in any way therefore you are free to attempt to secure financing for any purchase you wish.

        Thanx for the replies.

        We're going to go for the deal on the house...(should be meeting this week to finalize the deal and get everything ready for closing...hopefully close before the end of the month)
