    341 Meeting AND a Hearing?

    Hi all,

    I'm new and have a 341 meeting next week. I just learned about Pacer so I went on and looked at my case. On the schedule I have a 341 meeting scheduled for next week and a hearing scheduled for next month.

    Does anyone know what that means? I searched the forum for "hearing" but nothing came up.

    I did more poking around, is this the confirmation hearing? It would be just my attorney then, right?

      Are you reaffirming an asset? I believe there is a separate hearing for that purpose. I don't know much about the hearing, as I didn't reaffirm anything. Hopefully someone with more information will chime in.

        PACER hearing message

        Hi ndkblondie,

        hmmm, heard of reaffirmation hearings in Ch 7, plan confirmation hearings in Ch 13, but not a Ch 7 confirmation hearing.....But...if you post a copy of the PACER message, I'll bet someone here has seen it before and can explain it. Of course, on Monday your attorney can explain it too....

          I'm not reaffirming anything. The Pacer message just says "hearing" but when I open the docs attached to it they are from Chase, it's a waiver for relief of automatic stay. Looks like they just filed it on Friday. They are foreclosing on my house on Tuesday of this upcoming week and we tried to stop the sale. They just filed this. Anyone know if those are automatically accepted or will they make them stop and do a hearing first to explain why they should get relief? Fabulous.

            If you are behind in your mortgage payments they will file for a relief from the stay. (Chapter 7 correct?)

              Yes, 7 and yes, they just filed for relief... just three days out from the sheriff's sale. Are the relief filings always granted? Is this what the hearing is about? The hearing is scheduled a month after the 341 meeting. This is all so confusing.

                Clarity!

                The hearing is for Chase for their request for relief of stay, they filed it improperly so it didn't immediately go through! My house WON'T be sold on Tuesday! I have until 10/7 before they even have the hearing and can take next steps. Dodged another bullet.
