    341 questions

    Our 341 meeting is Tuesday the 14th...we have 2 debts that were some how overlooked and need to be added...do we tell the trustee at the 341?? Also our 341 is scheduled for 10am...does everyone get a different time or are we all scheduled at the same time and wait till we are called?? I also have more recent paystubs and bank account statements do I need to take those with me? Any advice is greatly appreciated...SSSOOOO nervous about this meeting!!!!

    If you have a lawyer - you need to bring the 2 missed debts to his/her attention immediately so your schedules and creditor matrix can be amended - before the 341. If you dont have a lawyer and filed pro-se then you need to do an amendment anyway - preferably before the 341.

    Everyone gets scheduled at the same time - but you get called up separately. You need to take with you your drivers lic. social security card (both are mandatory) - but to be safe I'd bring your bank statements and paystubs. Our trustee had all of ours prior to our 341 (statements/stubs) but we brought them anyway just in case - as well as updated ones.

    No worries - you'll be in and out before you know it ;)

      I worried about ours for days and we were in and out in 5 minutes. I wouldn't bring anything other than your license and social security card unless your lawyer or trustee asked for it in advance. Trust me...don't waste ANY time worrying about this! Did you have a telephone meeting with the trustee? If so, the questions that you were asked during that meeting are the exact same ones you'll be asked at the 341.

        I agree with the others, don't waste your time worrying about the 341, just be honest and answer all the Trustee's questions. You will be in and out of there in no time Then you'll wonder what all the worrying was about and move on to worrying about the WAIT after the 341

          Agree with what everyone has said. It may help to go a little early and watch a few cases. I know that helped me with the nerves. In the notice you received about the 341 it should say what you need to bring. I had to bring bank statements and paystubs that included the filing date. He only asked to see the bank statements. It is a quick and painless process. Good luck.

            Take care of the missed debts as soon as you can, though today is September 11, and you won't have much opportunity before your 341. If it hasn't been taken care of by then, if and ONLY if, the trustee asks if everything in your paperwork correct, then answer that you discovered two other creditors that you overlooked, and that you will be filing amended schedules. The trustee may ask additional questions, but may not. Never volunteer any information.

            Other than that, if you are unfamiliar with the location of where your 341 is located, take a drive tomorrow, and make sure you know where the place is, and where parking spots are. On Monday night, do your best to get a good night's sleep, and leave Tuesday morning plenty early in case there are any traffic problems or delays on the way.

            Carry with you only what you were told to bring, except you may want to bring a bill from the two missed debts, just in case. Dress conservately, and leave any flashy jewelry--even if costume--at home. Good luck to you. I am sure you will do fine.

              scope out 341 location

              Hi all, Hi jelo6875,

              Apparently people forget unsecured debts/creditors all the time, never seems to be a big problem. In fact, in our district you can add unsecured creditors to your creditors matrix by just sending them to the court clerk, not even a filing fee.

              I just wanted to second A.C.'s advice to find the place ahead of time.....I didn't and ended up in the wrong building and late to our 341....talk about avoidable stress....
