    mine was a CH 7 no asset case and never heard a word except for reaffirmation and final discharge. PACER is the way to go!

      Whats the legal procedure to get your assets?

      noone elses name on it,was not exempt,No asset case ,I was discharged,waiting on closing.....Basically what was said at the 341 was I was going to surrender the piece of land to the trustee,I was asked what i planned to do with it and my lawyer sai I was going to do that,That was all that was said ,trustee just shrugged I wonder if i shouldnt of said that,well still nothing has been said about it since,but I have other assets possibly also,but he never said anything about other assets as possibly one house having some equity was the only problem he saw,I wonder what they have to do to get the land as far as legally,do they get a court to grant them the right to sell it,i doubt if they could sell it very quick,it is a city lot and I bought it from someone who had it for sale a long time maybe 3 years before I purchased it(worth about 10k on a good day),funny to see what will happen.I do have a person who wants to purchase it he has been calling me ,but they dont know that.

        have you called your attorney? You can also sign up for PACER. If you don't go overboard with the pages you want to see then it is cheap (frankly, it's cheap anyway). I have only used it twice and has amounto to less than $10 (A lot less) http://pacer.psc.uscourts.gov/

          You said you were discharged and waiting on closing....
          Somewhere on Pacer it should be flagged stating that you have land that is to be sold.

          ALSO, the trustee has to petition the Court to sell the land and the court has to approve....

          Look for this petition on Pacer.... see if the Trustee has filed a petition.

          Hate to tell you this but my Trustee held my case open and did not file his petition to sell until almost a year after discharge....... to sell my home.

          So be patient, he may still be planning on taking it and just hasn't filed his paperwork.....

          Keep us posted.

          PS, while your case is still open YOU CANNOT SELL THE LAND!!!

            Oh i found out today trustee wants the appraisal on the land ,I told my lawyer he can call any appraiser to have it done,they are listed in the phonebook under "Landappraisers" thats where I got mine

              I have a question for you Minny...What do you think will happen if I sell a vehicle that I am 100% sure falls under my exemption before case is closed? My attorney already said vehicle is exempt and trustee should not go after it and my case was just discharged and what he said at my 341 is holding true ,he is only snooping after the land i own and a rental house,Nothing else,but i am in desparate need of some cashflow as my mortgage is 2 months in arears and I dont want to get behind any more,I am basically just waiting on a closing to sell.i already have a buyer and I would be able to catchup with bills if i can sell it,Do you think I will be screwing up? Whats the worst case scenario? freakin lawyer is no help,even if I do happen to catch him on a rare occasion he will say to wait,but I dont want to get put into forsclosure.
