    ps Tobee,

Yes, I do have copies of both original and Amendments. and yes, the corrected Amendments show up correct on PACER. What boggles my mind is this crazy $69k Assets. Can't figure out where that number came from?

Don't think it would be very smart to just let it go.

Please read my post over again. the error is NOT in the Amendments. I refused to allow them to file any Amendments without my review. They had already IGNORED my new appraisal FIFTEEN days after they had it in their hot little hands. Was not going to take a chance with them a 2nd time. Believe me it was quite a struggle to get them to do it right. Correction after correction. When finally they had it right then and only then did I sign. Like I said before neither the Trustee nor the atty can dispute the new appraisal which only gives me $977 equity on my home because the appraiser TEACHES other appraisers, so they had no choice but to accept my Amendments.

Now even if they use the excuse that they have to use the original WRONG numbers from BEFORE the Amendments.....it STILL could never add up to $69k Assets. This is the Trustee Report....NOT the Petition. I am not nor do I think is anyone else privy to review the Trustee's Report. Still if the Trustee report has the wrong numbers on it. There MUST be some recourse. This does NOT involve NEW Amendments, as the Amendments have already been filed and ACCEPTED by the Trustee.

I am thinking it is very possible that the Trustee counts on the atty to file his report. Wouldn't surprise me as my atty made so many wrong calculations already.

Hope that clears it up for you.

      Chris
no thanks...i have read them enough, and frankly, i am intelligent enough to get it the first time.

i would have a sit down with your atty and have them right in front of your correct the issue...end of story.

      if not....

get yourself another atty....instead of wasting your time and energy on this...anyone that has ingored their clients request need to be fired or you need to go to a senior partner and get it straighten out.

        Tobee,

If I had enough money to pay for a 2nd atty, I would not be filing bk. My atty's office gives out a flyer of "no walk in policy"....meaning, if you don't have an appt ....you are out of luck. Course you don't get this flyer until AFTER you have paid.

I still need them to sign Reaffirmation for my Toyota also.

Well, if you got it the first time Tobee, then WHY are you telling me to file an Amendment? Yes, you actually do seem intelligent to me, but this is not the first time you "missed" what I have posted.

Not that I don't appreciate your trying to help. Just hard to keep repeating what I have already said.

        Thanks,

        Chris

perhaps it's your harshness that's not allowing you to be as clear as you are attempting. read back on this thread and i think you'll understand what i'm getting at.

if the petition is STILL incorrect it needs an additional amendment. you can file 20 if you have to.

you are expressing over and over again that's is still wrong. you must do so to your atty. and personally, i would not leave their office until the situation is corrected.

again you say you don't know where the 69k comes from....i just don't get that??? you should know, and if you don't, you have to corner them to explain it and if they do explain it and it's not what you want then you need ANOTHER amendment.

these atty's can and will have you going around and around until you, yourself put a stop to it.

                Hi Ladycee,

I can take one thing off your plate: ...don't these numbers get reported to Credit Reporting Agencies? No

Good luck with the mystery numbers on your trustees report.....reminds me of a bank I once dealt with; they could never get the numbers right and couldn't explain how they got the numbers in the first place.

                Tom in Colo
                Ch7 filed 5/12/2010.....341 meeting 6/30/2010....report of no distribution 8/15/2010.....discharged 10/01/2010.....closed 11/09/2010

                  Thank you Tom,

Thank God somebody understands what I'm saying LOL....and also thanks for pointing out that Credit Reporting Co's don't get the numbers. That's a relief!

My atty and his Trustee are "joined at the hip". The atty sometimes acts as a stand-in Trustee for him. This explains my suspicion that he actually filed the Trustee's Report. Since he made so many errors on my Petition, wouldn't surprise me, and maybe that's why he's not answering me yet.

Maybe I'll just be satisfied that my email to my atty documents that I informed them the Assets were wrong, just in case it comes back to haunt me.

So Tom, when do you think it's a good idea to get that one free credit report we're allowed annually? Should I wait till Discharge/Closed?

thanks for chiming in, much obliged,

                  Chris

                    Hey All!

Here's the response from my atty:

                    Dear Chris,

The numbers need not be understood, but are derived from your schedules. Exemptions less than assets if there are secured loans. Your case is going to get a discharge. Attached please find the first of two reaffirmation agreements you will get. This and the other will also be sent to you via first class mail, likely Monday. We will need an appointment to go over them.

In other words: Mine is not to question why. It will be discharged that's all you need to know......

I will save his answer in case it rears its head in the future....

                    Thanks all,

                    Chris

you were rude to me once before....you need to get a grip or you're going find yourself having a breakdown.

and i suggest if you want help on this board...and i only mention it because someone already has mentioned your rudeness and i had let it go, you best stop your attitude since it prevents people from wanting to respond to you.

tom she's been told the same over and over and just can't get it....these numbers don't mean anything...and can be cleared in a instant, which has been already explained.

it's really no wonder you atty is having such a difficult time. really...you need to really get it together...for yourself.

and if you don't like the answers you cannot continue to ask the same questions.

your atty, if you have anyone that is worth what you paid...should be able to make one phone call and resolve this. and if not, call the clerks office yourself and made the corrections...once again you'd been told these numbers can be changed....and AMENDED by the TRUSTEE..........NOT YOU. clear enough?

                                So anyway.....

Back to the business at hand...The Reaffirmation from the mtg company does not look so good to me.....from what I see they are adding on $343 fee to the principal and that is before the Oct + Nov payments have been calculated in.

I guess I will choose to ride through on the mtg, this way should I decide to pick up and move, it will be a dischargeable debt.

I just hope the Toyota Reaffirmation is better.

I've already been working out a budget of how much storage will cost me etc. I would actually love to move to Florida just spooked by the Gulf Oil Spill.

And on another post they were advising an OP to just get a camper and a cheap lot either in TX or FL. Getting really tired of the nasty winters up here.
