    Can schools refunds be included in 6months of income needed?

    Can schools refunds be included in 6months of income needed?

    When it asks for the last 6 months of income average - our paycheck shows our work reimbursing us the costs for school. Do we have to include that in or is it excluded? Is there a law or a statement to this effect?

    Just to clarify....

    You pay for school; tuition, books, fees, etc
    Turn in receipts to employer
    Employer reimburses you for what you paid

    Technically, getting reimbursed for something is not income...but stranger things have happened in BK....

    Is the reimbursement listed separately on your paycheck? Just seems that this issue will be easier if the reimbursement is not lumped in with the regular pay. Maybe your payroll person could get you a detailed statement....

    ...but we need some of the more experienced forum helpers to chime in here...

      Yes, we give work the invoice and they send us the refund to pay school.

      It's listed separately - with a mark on it as a refund, in a separate section on the paycheck.

        Paid tuition benefits from an employer are considered income for irs purposes, so they would be considered income for bankruptcy as well.
