Was just wondering if credit and student loans for my girlfriend who is NOT filing bankruptcy and is NOT a cosigner on my loans can be factored legit on her budget and adversely effect how much money she contributes to the HH?

Hi dtaild,
If I am not mistaken you include what she is actually paying on a regular basis. So her budget is not a factor, just what she is paying.
backtoschool has great expertise on roommate/household issues, do a quick search for his posts on roommates.

Ok so I basically what she has contributed to HH expenses in the past 6 months and average it out?
I went and talked to a lawyer on Friday and have been exchanging emails wit him this weekend and he's telling me that she will have disposible income left over...
I am, along with her expenses, below the median income here in Jersey, though I am on the border with having disposible income left over
I filled out budget sheets that are actually provided on the same lawyers website which are pretty handy. We filled these out based on our last 6 month #s and basically I have about $190 left over and she has $34 left over...
Then he says she has disposible income left over was just wondering if he was saying she had left over money because he didn't consider what she contributes to her student loans and cc bills

This for sure.
Then the question is "do I have to count the rest of her income?" This does not seem to be as clear cut, go with your attorneys advice.
(Of course, if you are claiming a household of 2, it is clear cut; you have to include all her income.)

From what I have researched it would be:
Her income - bills she owes (thus income not contributed to household) = her household contributions.
Here's a reference that discusses the marital adjustment, which is believe would be the same in your situation:Stopped paying 8/2010, Filed 2/2011, 341 3/2011 done, Report of no distribution . . . Discharged & Closed 5/2011!
