    Got a new document @ PACER

    Considering the Trustee's Motion to Sell Property of the Estate, the lack of objection thereto, and applicable law;

    IT IS ORDERED that (the Trustee) is authorized to sell to (me) for the sum of (~$5K) cash by private sale without any warranty or recourse whatsoever on the part of the Trustee, even as to the return of the purchase price, but with full substitution and subrogation to all rights and actions of warranty against all preceding owners, vendors or mortgagors, the property described as:

    Equity in House located at (my address ($4000) ); (my other stuff (~$1,000) );

    IT IS FURTHER ORDERED that the property is being transferred "as is, where is" and subject to any and all taxes and liens that may affect it.

    So it sounds like I just officially bought my stuff back. Should the closing be not far off?

    I am curious how this process is done. Did they send you an offer letter and you accepted? Did you negotiate the price/terms?

      My trustee sent me a letter saying that I would need to pay the full amount per the schedules. I counteroffered based on the fact that the house sale would require a realtor fee (I probably could have asked for more but decided not to get too greedy.) He then accepted it, but evidently it was only contingent on no one showing up at court to outbid me (nobody showed up.) This letter seems to say that no one outbid me, so he sold my old stuff back to me.

        Should the closing be not far off? The BK case or the house?

        Don't hold your breath on the house selling or foreclosing...some folks have waited years......you might be able to get some rent-free living in the meantime.

        Hopefully the BK case goes on schedule and you will be done and clear !!

          Yeh, agree, depending in what state you;re in, you could be living in your house for quiet awhile.

            The house sale here was hypothetical - would have been done if I had decided to just let the trustee take it. There is no mortgage on the house.

            As for the closing, I am referring to the BK.
