    Difference between able to file and odds of discharge

    We are below the median income for our state, however we may have some disposable income. So when they say being below the the median income means you pass the means test does it also mean there is a good chance you will have no problems being discharged?

    The means test is just step 1. If you have sufficent MDI, you can be pushed into a 13 even if you are a below median filer.

      Means test is only to determine whether or not you presumptively qualify for a CH 7 or not. The meat of it comes from you real DMI from schedules I vs. J. Are you sure you have some disposable income? Is it monthly? How much is it? Have you really taken ALL your expenses into account?
