    Attorney no longer MIA!

    As suggested I wrote a stern, professional letter to drop off at my attorney's office. It is so hard to get a hold of her, that I didn't think she would be there. In my contract it does state that she will prepare me for the 341, so I used that verbiage in my letter, but she was in her office and so I didn't even need the letter!

    As expected it was a very short meeting, as I just had a few, but important issues. She was very apologetic and said that I was supposed to get a letter giving me info on the 341, but some of letters didn't go out. Then she got slammed, I guess business must be good.

    Anyway, she understood my concerns and took time to answer my questions. There is no need to amend my petition. She said the student loan disbursement will not be an issue. So on to the 341. Thanks again to those of you that responded. I really appreciate your help.

            Non-responsive attorneys

            I have worked for attorneys for 30+ years and never in my career did I see an attorney so non-responsive than the attorney I hired to do my BK.

            It got to the point that I personally emailed the Senior Partner outlining all of the unresponsive calls and emails. I truly blasted off in this email.

            The following morning I got a reply from the Sr. Partner which also cc'd my attorney that my attorney was not to work on any firm business until my concerns had been handled. Truly, I do not think I could have written a more stern email to anyone, but I had simply had it with the unresponsiveness. I suppose it was a SCREAMING wheel gets the grease type of situation, but it did get resolved.

            Unfortunately, in your case, you only have the single attorney to deal with. If need be, you may want to mention grievances that can be filed on a non-responsive attorney. No attorney wants to be listed in the monthly lawyer magazine as having a grievance filed against them. And, this most likely will not hurt your case since they have to continue to follow the rules, and perhaps more timely.

            It worked in my case, perhaps not in others.

              Thanks LizardTail. Sorry you had to go through that. I spent time writing a stern letter, but I didn't have to give it to her as I was able to met with her in person. She apologized profusely and I sensed she was being sincere. I just think she is overwhelmed, and needs an assistant, but still that is not my problem! Anyway, the situation has been ironed out and hopefully she will show up tomorrow at my 341. I'm sure she will.
