    Taxes were UNDERWITHHELD on Unemployment Income - How to handle on MEANS TEST?

    I have been receiving unemployment income, and the amount taken out for taxes is UNDER what I am likely to owe.

    For the Chapter 7 Means Test, what should I do?

    Scenario/Example:

    * I receive $1,000 in gross unemployment income.
    * I have 10% taken out for Federal Taxes (and the amount I will owe is 28%, so I still owe 18% = $180.)
    * I have 6% taken out for State Taxes (and this is correct.)

    I am cutting it close on the Means Test. Every dollar counts.

    Can I put down the other 18% that I will owe on the Unemployment Income? If so, where do I place that amount?

    If I cannot put it down, can you explain why (and has there ever been a case where this was decided?)

    Short answer is yes, mandatory taxes are the one item that you are allowed to be forward looking on the means test. Going through the same situation with severe underwitholding and attorney is using future-owed tax calculations for means test and schedule J. Be prepared to provide calculations showing how you arrived at those amounts (such as IRS witholding calculator).

      unemployment i know where we come from will only take out a "limited" amount of taxes...


      however, maybe one needs to look at the means test a different way....

      aren't you getting more head aches?? sounds like the pharmacy is going up

      your so nervous about everything you need to eat 24/7.... your food cost just jumped from 400.00 per month to 650.00

      you can't sleep at night because of the added stress of all this...so the tv's on all night...wow...i think this one could help up the means test with both pharmacy and utilities expenses...LOL!!

      your correct every dime counts...so you have to count every single dime.
