    Quiting job due to another child

    To get us under the means test could my wife be placed on leave for the year or just quit due to child birth? We are going to have 2 little ones under 3. She is a teacher and live in the state of Washington. We feel our family would be better off with her home and to file for chapter 7. Would this work? Thanks!

    No law requires you to be employed in order to file bk.
    You will not be the first person on this site who quit a job or refused OT in order to qualify for a Chapter 7.

      Hi stockbooi,

      As long as you never tell the child the reason you had him/her was just so you could go bankrupt.......

      But then, maybe they would grow up to be a BK attorney...?

      Seriously, my wife and I went through this exact situation. We filed BK so she could stay home with the kids (two daughters) and not have to find outside work. One of the best decisions we have ever made !! We were poor, but when life happened, Mom was always there for the girls. Never regretted the decision to BK then downsize for the sake of the kids.

      Hope you can work it out where Mom can be home with the kids.

        Remember that you cant file as soon as she quits if you are concerned about passing the means test with her income. You'll have to wait for her income to drop off.

          I totally agree with keepmine. I was laid off from my job six months before filing, and and refused several other jobs I was offering in that six month look back period in order to get my income down low enough to qualify for a chapter 7.

          I ended up going back to school full time to get another graduate degree instead of taking a job (I am now working full time and in school however....)

          Without the lay off and "changing careers" and going back to school, I would never have been able to file a chapter 7.

            Just want to clarify that my wife would be taking a leave of absence for 8 months or so to take care of kids. She technically would still have a job but no income for 8 months. Would this work in the state of washington to qualify for bankruptcy. thanks!!!!

              Not working is not working, anyway you slice it or dice it. It's fine.
