    Petition is complete getting ready to file - Items needed?

    Hello, we have our pro se petition complete and ready for filing but I have questions about what docs should accompany the petition like car titles, insurance ect for the initial filing could someone help me with a list of items needed for filing other than the petition?

    Also do my wife and I both have to be present when we file and pay our fee?

    I used an attorney, so I don't know if you both need to be present. As for documentation I had to include:

    6 months of bank account statements
    6 months of credit card statements
    6 months of pay stubs
    4 years of tax returns
    Car title
    Copies of contracts - eg. rental lease
    Student loan statements
    Profit & Loss statements (I have a business)

    I think that was all I had to submit. This may vary by district. Hope this helps.

        I believe each district has different rules regarding initial submissions. In my district, we only submit the full petition docs & last year's tax return. The trustee will ask for further docs if he/she deem necessary prior to the 341....but that's our district. Check your local BK court website for specific rules.

          colo filing experience

          Hi strummerfan,

          You hit the goldmine with that .pdf from the court......

          When we filed pro-se in Colo, we both did not have to be present, they wanted the filing fee in cash, and the clerk was very particular about the formatting of the creditors matrix. Also no staples and make your own copies before you go.

          We, too, found a list of documents to have and the order to have them in.....and the clerk promptly rearranged all the documents...oh well....

          In our district, the BK notice showed (in fine print, had to squint) what was needed to take to the 341 meeting. And BK law says to have 2 yrs tax returns sent to the trustee once you get one assigned to your case.

          Hope all goes well for you, our clerk complimented us on the nice job we did with the filing !

            I filed Pro Se today, with no problems I got the A+ nod from the clerk as well, it was a piece of cake. Getting the docs proper was not so simple but I hope that sets the trend on my case, a seasoned attorney actually recommended that I file Pro Se, I'm a veteran and with all the other hogwash that I have gone through the last few years he said my case is a simple slam dunk...

            Gawd I hope so. I do admit its a big relief.
