Are UNEMPLOYMENT BENEFITS counted as income on the MEANS TEST?

    It appears that in the district I am in (Northern Georgia) - the court is weighing in on the side that UI benefits are to be counted as income.

    Here is the actual case from May, 2010:



    Ugh!
    Over Median Income - 10/04/10--Filed Pro Se Chap 7/ No Assets 11/10/10--341 Held 01/18/11-- No Distribution/No Funds 01/19/11--Not subject to dismissal under 521(i)(1) AND --Reaffirmation Hearing Held = APPROVED 02/10/11--Discharged

      i read the case...i think ....that makes no sense....so what is this poor lady to do when the unemployment payments stop...in let's say, as an example...3 months into her pay back plan...

      what is she suppose to do??? go BACK to court and have the payments adjusted accordingly??? incur MORE legal expenses??? this is temporary income? unless they worked out her payout amounts keeping in mind this was only temp. income???

        I swear if they do that to me, I will ask the judge and the trustee that since this is temporary income, they our the court will have to incur the extra legal expenses when it has to convert back to a 7, and if they are going to use your UI, they can only put you into a 13 for 2 years or less depending how much UI you have left.

        This makes no sense and I don't see how it can even be legal

          I am over the median income and my Unemployment Income is hurting me on the Means Test.

          One thing I have learned is to make 100% sure you have the correct taxes withheld - and if you have not - to still mark down the amount you would really owe.

          The tax expenses can help!
