Hello all,
I have a no-asset case; 341 hearing was on Thursday. I am upside down on a poorly performing auto - the only vehicle we have (wife, two children). I want to expolit the opportunity to rid myself of this burden while I can but so far I've not had any success in arranging other transportation.
I can take a small loan from my paltry 401k as a cash payment/down payment. Any thoughts/advice/experiences on incurring debt before discharge? Is this a matter I should discuss with the trustee? Are there legal restrictions on incurring debt at this point in the case?
On background, my trustee has actually been an asset to me in my pro se filing and someone with whom I would be completely comfortable discussing procedural issues.
