    Means Test: 401K Contributions

    Am I able to enter my 10% 401K contributions on the means test? Is that a legitimate monthly 'expense' to get excluded from my income on the means test?

    You asked the same question as to 10% for tithing also...are these actual percentages you are currently donating or having withheld from your paycheck for your 401(k)? If not, and you are having this all done recently, there will be issues. If you have been donating to your church for a while and also having funds withheld from your paycheck for your 401(k) for a while, can prove it, then all should be fine. If you are just wanting to list the percentage without proof or backuup, you will have issues. Discuss with your attorney.

      We were only putting 5% in my husband's 401K and the lawyer told us to stop. Sucks cuz his company matches 1/2. As soon as the discharge is done, we'll be starting it back up.

        401k contributions often get questioned and flagged by the US trustee, it depends on your district whether they will be accepted easily. If you are over median income and are a candidate for chap 13, the US trustee may stop the 401k contributions to try to put you into a chap 13, especially if you increased them recently.
