We have a student loan, and IRS debt. Some of the tax debt should be discharged- but the IRS has that sneaky way of applying paymets to the oldest taxes owed. I'm concerned if I get back on a payment plan with them now, they'll just apply payment to tax debt that would be discharged anyways. Will they even work out a payment plan with me before discharge? Same thing with student loans- can I resume payments at any time?

You can voluntarily make payments anytime - but they should not start billing again til after discharge. With the tax debt - I'd wait if I were you. Should be no harm on the student loans though.Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
(In the 'planning' stage, to file ch. 13 if/when we have to.)
