    bankruptcy and marriage credit

    Hello Everyone,

Does the credit of a spouse who marries someone who just received a bankruptcy discharge face a credit hit?

We live in a community property state and I suspect the answer maybe yes.

    Thanks

    No.

Credit files don't actually merge when people get married. The only impact would be if you had joint accounts, loans, etc. that were included in the bankruptcy. The other party would still be responsible.

Ps-living in a community property state is not relevant since the debts in question were prior to the marriage.

Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
(In the 'planning' stage, to file ch. 13 if/when we have to.)

SMinGA is right. You don't have a merged credit file because you are married. It doesn't exist. Your files remain separate and whatever your spouse does with their credit does not affect yours as long as you do not have joint accounts.
I may be smarter than an attorney, but I'm not one. No legal advice here, people.
