    New question needing an answer

    All,
    I have a new question that needs an answer please. I'm awaiting our discharge in late August and did not reaffirm my first or second mortgage. I called the city to see if my mortgage has paid our summer taxes yet and I was told no that they were not paid. Will my mortgage company pay my taxes (we do have a tax escrow) while we are in bankruptcy? Does anyone know? Is it standard to wait until after the discharge for them to do so?
    One more question...If I had late fees on my mortgage account does this mean I'm no longer personally responsible for them since we did not reaffirm? If I sell my home and the late fees are still there can I "walk away" from those because I did not reaffirm? I know I can walk from my home at any time but just wondering if this would make a difference?

    BK should not impact how/when the lender pays the taxes. Did you check to see when they paid last year? Are they overdue yet?

    I don't think you can get out of the late fees unless the mortgage co waives them, unless you're giving up your house. The mortgage company does not have to accept partial payments, and if you pay less than you owe: its a partial payment. At some point the fees will accumulate enough that they will refuse your partial payment and you'll have to either catch up in full or they will proceed with foreclosure.

    You don't owe the debt - but they did not lose their lien on the property either. If you want to keep the house, you keep paying by their terms.
    Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
    (In the 'planning' stage, to file ch. 13 if/when we have to.)
