    Medical debts incurred for minor - dischargable?

    Got a call from a medical collections place today. It was on a bill for an ER visit for one of our kids. It was listed on our matrix but I think this is a new collection agency since the debt is 2 years old.

    Told the woman on the phone about filing. She told me it didn't matter that debts incurred for minors are not dischargeable but I could pay the balance in full today and they would knock 30% off the bill.

    I hung up. Lawyer is closed for the day, what do you think?

    Keep copious notes in case of another call. They now know about the bankruptcy; if they call, it's a stay violation.

    It sounds like you have a collector who is very wrong about BK law.

      Umm the major reason we're going into bankruptcy is because of 60k in medical debt for our son. That collector is about to pay you $1500.

          Sorry you had to field that call but that collector should get a raise in pay. That's the best line of collections BS I've heard about in a long time. Give the devil her due, pretty fast footwork or I should say phone work.

            I figured she was full of it. I have their information and I will pass it along to my lawyer. She was pretty good though, made me pause there for a minute!

              That is a new one!!!!

              I guess if the "minor" acquired all the debt then they could not be discharged, because that in itself is illegal for a minor to have credit with out a guardian or parent signing for the debt.

              If she calls back I would tell her that minors can not file BK, but the parents are responsible for all their debts and they CAN file BK.

                Since the minor cannot be held liable for his/her bills, the BK would discharge your obligation to pay them. Even though they may come in the child's name...
                Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
                (In the 'planning' stage, to file ch. 13 if/when we have to.)
