My fiance is in the process of filing for bankruptcy and we plan on getting married after her discharge. We live in a community property state and it seems that is the safest thing to do.
One question: After we are married, her income will increase dramatically because since in a community property state half of my income becomes hers.
If we get married in the year following her discharge can the trustee say that now since her assets are greater they will go after me for her debts?
I think I read that in the year following a discharge the debtor must report to the court any significantly changed asset situation.
Hate to think we need to wait a year after the discharge to tie the knot.
