    marriage and bankruptcy

    Hello Everyone,

My fiance is in the process of filing for bankruptcy and we plan on getting married after her discharge. We live in a community property state and it seems that is the safest thing to do.

One question: After we are married, her income will increase dramatically because since in a community property state half of my income becomes hers.

If we get married in the year following her discharge can the trustee say that now since her assets are greater they will go after me for her debts?

I think I read that in the year following a discharge the debtor must report to the court any significantly changed asset situation.

Hate to think we need to wait a year after the discharge to tie the knot.

    Crazy world.

    Thanks

I am assuming she is filing Chapter 7? If she is completing a Chapter 7 then after she is discharged she will not be under the watch of the court system. She does not have to report anything to the court system after discharge if she is completing a Chapter 7.

Only a Chapter 13 requires her to inform the trustee of any changes to her income, marital status, or living arrangements.

Chapter 7 no-asset cases are pretty cut and dry.
    Chapter 7 filed on 4/23/2010
    341 meeting on 5/28/2010
    Discharged on 8/19/2010
