Where did you get $ for your lawyer & filing fees?

    I used my tax refund and pell grants to pay for my lawyer.

    Student loans are not discharged in BK, but the good thing about student loan companies is they should be able to work out a payment plan that will be able to fit your budget. you need to speak with them about a payment plan that is right for you. Plus of you do not make much money the company should be able to work with you as long as you have not defaulted on the loan.

      My wife and I are filing pro-se. We do not have the money for an attorney, and we are being sued.

      My wife has started the paperwork. I would not say filing pro-se is easy. It takes a TON of time, and patience.

      Your friend may be able to help you with your paperwork.

      Student loans won't be discharged. But yes, they are usually pretty good about helping with acceptable payment arrangements. If you are making so little, you can also contact them and have your payments put on hold due to "hardship." I've done that before.
      I may be smarter than an attorney, but I'm not one. No legal advice here, people.

        Hyatt Legal plan thru job covered everything except the court filing fee's.(Which was IIRC about $250 or so) and the before and after education classes (another $50 or so)

        If anyone here is thinking about filing BK next year and they are offered a Legal plan at the start of the new year at work I suggest getting it.

        We paid approx. $300 all together.

          sorry to hijack op, but CCsare evil, can you explain your sig?
          We were questioned at the 341 yesterday about our $6000 refund in Feb. Will that make us an asset case?

            By some miracle I found a compassionate attorney that took my case pro bono.This I think is completely unheard of!

            I actually gave him $100 deposit in January and thought I had a plan to pay him the balance (he quoted me $1100 plus filing fee's)

            He contacted me about a month ago to find out what was going on and I explained I just did not have the money, did want to file etc etc...He asked me if I could come up with the remainder of the filing fee ($199) I said I could try he said lets just get this filed for you I'm going to take your case pro bono..

            I actually went to him for 2 reasons...#1 I heard he was the ONLY attorney in town that would do a filing on a sliding scale based on income #2 he handled my mothers case in 2005 (which I paid for so not sure if that is why).

            I signed my papers today and I don't think it was that I was anyone special their were others that were signing pro bono as well, I think he's genuinely a nice guy that believes in what he does..they were also putting in to have our filing fee's waived.

              I got a longevity bonus at work for staying there a year as they usually have a pretty good turnover. The lawyer I talked to wanted $1299 which does'nt sound too bad and I will still have a little left over. I'm just wondering how good he is as he is not listed on BBB, but his ad says he's been in business for 22 years.

                Being listed with the BBB or not means nothing. A business is listed for one of two reasons: 1. They are a dues paying member (which does mean they have to pass certain standards, so that is a good sign because if they do not they are not accepted for membership). or 2. They have had complaints filed against them, so they are in the BBB database. Not being listed simply means that he is not a member and has never had any complaints, so that is a good sign.

                  There are two options regarding the filing fee. You can pay the filing in installments, usually no more than 4 installments within 120 days of the date of filing for bankruptcy. Go to your particular local court's website to see their requirements. This is Form 3A. Also, there is another form to completely waive the filing fee. If you earn less than 150% of poverty level, you should qualify for a filing fee waiver. If your only income is $850.00 a month, then you should qualify for the waiver. You probably will have to attend a separate hearing on the matter, though. This is Form 3B.

                  As far as the attorney's fees, you can also try Legal Aid. They might be able to help you, again if your income is low enough. I think they usually have a limit close the poverty line.
