I met with the lawyer yesterday, put the retainer down today. Anyways, I went with her to discuss a Chapt 13 (as a previous lawyer told us to do, he didn't even look at our expenses or income). She asked for all of our expenses and income, which at the time was just my husband's. She said that we qualified easily for a Chapt 7 with our expenses and income. We are also foreclosing on our condo that we are way upside down in.
I have been unemployed for almost 2 years and my u/e ran out 3 weeks ago (I had used 79 weeks of the 99). Well, with this extension given now, I all of the sudden have 20 weeks left. Does that get included in the means test now? We weren't planning on filing until Sept/Oct - that's when we'll have the money around to pay the lawyer/filing fees. Should I wait until November to file, that's when the u/e will be done or should we continue on with the Sept/Oct filing? I have emailed my lawyer but I found out about the extension after she went home for the day. I'm afraid with the u/e we will be on the border of not being able to file Chapt 7. My husband says not to claim any more weeks of u/e and that fixes our, all of the sudden, extra $1200/month. Sorry this is so long.
