I'M A POLIO SURVIVOR AND MY CAR HAD TO BE MODIFIED FOR MY MOBILITY. WE ARE SOON TO BE 64 AND 72 IN AGE. WE FEEL OUT OF RUNWAY ROOM, AND FIXED INCOME, I'M STILL ON SSDI TO AGE 66, THEN REGULAR SOCIAL SECURITY BEGINS. MY H IS ON FIXED RETIREMENT AND DUE TO HIS EX WIFE'S GAMBLING, SHE WENT THROUGH OVER 100 k, HE HAD TO RETIRE AT AGE 67 WITH FULL BENEFIT AND NO SURVIVOR BENEFIT. HE TOOK OUT A TERM LIFE INSURANCE TO AGE 85, I HOPE THE COURT DOESN'T MAKE US STOP THAT PAYMENT, IT IS ABOUT 300. A MONTH, BUT IT WOULD BE ALL I WOULD HAVE. OUR HOUSE IS NOW WORTH 144,000. WE OWE 233,000. BANK OF AMERICA TOLD US WE WERE IN A TRIAL PERIOD MODIFICATION AND LOWERED THE PAYMENT, JUST PRIOR TO FILING THE BK WE LOOKED ONLINE AND SAW THAT WE WERE IN ARREARS THEN BY 3000. NOW IT'S MORE LIKE DOUBLE THAT, AND THEN SOME., WE WERE ALSO TOLD THAT THE MOD WAS DECLINED, 4TH TIME UP TO BAT. THEN WE GOT A STATEMENT JUNE 30 THAT SAID TO KEEP MAKING THE MODIFIED PAYMENTS, EVEN THOUGH THE TRIAL PERIOD ENDED IN APRIL. WE DON'T KNOW WHETHER TO GO SAILING OR START PACKING. THERE IS NO ONE HERE TO PHYSICALLY HELP US MOVE, AND WHERE TO ANYWAY? NOW THAT WE ARE IN BK, WOULDN'T IT MAKE SENSE THAT THE B OF A WOULD THINK OF US AS A BETTER RISK THAN PRIOR TO THE BK? WELL THE ATTY TOLD US THAT IT'S A LITERAL CRAP SHOOT AS TO WHETHER THEY WILL TAKE THE HOUSE OR LET US STAY WITH THE MODIFIED PAYMENT OR JACK IT BACK UP. IF THEY DO INDEED JACK IN BACK UP, WE'RE OUT OF HERE ANYWAY, WE CAN'T AFFORD IT EVEN WITH THE BK. WE CAN MAKE THE MODIFIED. WHAT ARE THE CHANCES WE WILL STAY HERE, AND HOW LONG WILL IT TAKE BEFORE DISCHARGE IF WE FILED JUNE 23, AND THE 341 MEETING IS A WEEK FROM THIS COMING FRIDAY, JULY 30? A LONG TIME? WILL THE B OF A THEN DO WHATEVER THEY ARE GOING TO DO AFTER THE DISCHARGE? WE TRIED TO ACCESS THE B OF A MORTGAGE, AND ARE NOW LOCKED OUT. WE TRIED TO CALL AND WERE GIVEN FROM ONE PERSON TO ANOTHER, AND NO ONE SAYS THE SAME THING, WE'VE HEARD IT ALL, INCLUDING THAT LESS THAN 4 % OF ALL B OF A (OR OTHER LENDERS TOO, WHO KNOWS) ACTUALLY GO THROUGH...TRUE? EVEN OUR ATTY SAID THAT WAS ABOUT RIGHT, ABOUT 4 % OR LESS. IF YOU'RE OUR AGE, THAT DOESN'T LOOK TOO GOOD. ON TOP OF IT, WE HAVE VERY GOOD HEALTH INSURANCE BUT IT'S ONLY GOOD WITHIN 100 MILES OR INSIDE 100 MILES OF CLARK COUNTY, IN OTHER WORDS IF WE LEFT HERE AND WENT BEYOND THAT 100 MILES WE WOULD LOSE THE BEST HEALTH INSURANCE THROUGH THE COUNTY WE HAVE EVER HAD, AND THAT'S TOO SCARY TO THINK ABOUT. WE'RE BOTH ON EDGE, SCARED AND HAVE NO IMMEDIATE HELP, RECOVER FOR US AT OUR AGE IS VERY SCARY. DOES ANYONE KNOW ANY ANSWERS, SORRY FOR THE LENGTH OF THIS, BUT THAT'S ABOUT WHERE WE'RE AT. Not sure if I can post this here, so I am sorry if it is not allowed. I found this website and another the day we decided that we had to figure out that to do. The other is http://www.loansafe.org/forum/. It has tons of people trying to get loan mods, and walking away and is all about what you are trying to do. Maybe with this site here, and the other one I listed, it will help you along. Best of luck to you.

Hello,
my very first message about discharge, and i even apologized for the large font and caps, because i can't see, i'm 64 polio survivor in trouble over my head and having cataract surgery in the first eye on wed this week, the 21st, so the only way i can type for help is this way, and right off the bat someone jumps me for typing in caps/large print...tolerances anyone? I've dealt with tolerances and lack of tolerance my whole life, this rips it. I will get the other eye done down the road, but after this first one, i will be able to type and see without large print, for now i'm categorically stuck and can't post messages? I think someone owes me an apology namely whoever it was that sent me the note that said, 'if you want someone to post and read and answer, don't write big and caps...or whatever it was, i couldn't see it all..." cataracts obsucre and blur your entire field of vision!!!!!!!!!!!!!!!!!!! I need answers not this kind of response, and frankly if this is a family place, why did i get tht, when clearly i explained why i was writing in this way that i am right now!!!!!!!!!!!!!!!!!!! I even apologized for it!!!!

My suggestion if you're having problem seeing would be to write the note first in a text editor (Note Pad or Text Edit if on a Mac), setting the font size to as large as you want (all caps is harder to read, isn't it? Don't you want easier to read?). Then when you're done copy it and paste it into the field on the web site.
However unsympathetic you think HHM was being, I literally did find it unreadable. But I felt you pain and worry, and actually copied it into an editor and broke it into paragraphs.
Unfortunately I don't know anything about loan mods. However in a place as swimming in foreclosures as Clark County, I'd imagine there were rentals to be had at reasonable prices thus keeping you where your health insurance is valid. In California, one strategy is to drag out your foreclosure as long as possible, saving the cash and giving you a nice cushion when you're finally forced to move.
But really this is a question for a loan mod/ foreclosure site/board. I know your situation is hardly unique.

Keep in mind, this forum has no staff, everyone is a volunteer who graciously give of their time to try to help others. All I am saying is that the if you really want help or advice on this forum, you need to make it as easy and painless as possible for someone to do so. I guarantee that reason you have very few substantive responses is because as soon as you open the thread and see a HUGE block of type in ALL CAPS and simply hits the back button to move on. It's human nature.

I did complete a loan mod with Bank of America. It was not the federal/HAMP program - but an inhouse modification. Perhaps that is why mine went rather smoothly - no federal red tape???
Anyhow - they lowered my interest rate and that lowered my payment slightly but also brought my loan current (amortized missed mortgage interest payments) which was my primary goal. But I had to prove that I have sufficient income to handle my mortgage & other expenses. Our income has increased in the past year - due to my taking on a 2nd job. In your case, your expenses are decreasing as a result of the bankruptcy. (No more debt payments.)
The bottom line for you: what is your income/expense scenario and what mortgage payment can you afford? Based on the #s, is it possible for a mortgage mod to get you there? If not, then it may be best to start looking into alternatives such as renting.
You will probably find that Bank of America will not speak to you right now. Since you have recently filed bankruptcy, the automatic stay is in effect meaning they cannot try to collect money from you. They would need to lift the stay or wait for discharge. Discharge is usually about 90 days after you filed, possibly a little longer if the court is backed up. Once BofA has notice that your case is done, you could probably try contacting them again. I'd suggest specifically ask about inhouse modification options - might be less stressful? But you have to go into the mod process knowing it might not happen, and prepare for that worst case scenario.Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
(In the 'planning' stage, to file ch. 13 if/when we have to.)

Welcome to the Forum. I'm sorry your first response was not what you were looking for. I applaud you for seeking the help you need rather than putting your head in the sand.
I will also encourage you to go to Loansafe.org. It is a forum for people with mortgage problems. I used it myself and it was a great source of help and support for me while I was getting my modification from Bank of America. I got a permanent modification from them in March, after about 1 year of trying. It was the most frustrating experience I have ever been through. I have not filed for BK yet, but hope to by July 30.
There are people on Loansafe who have gotten a modification during/after BK with BofA so I know they can tell you who to call and when in the process to call them. It can be done. Hang in there. When you go to Loansafe.org be sure to go to the subforum for Bank of America so that you will be talking to the right people. If you can afford the modified payment I can't see why they would deny you especially with all the forclosures in Vegas. It would not look good on the news for them to post over 3 Billion in profits and then kick disabled older people out of their house!
I don't see why the Trustee would not allow your husband to have term life insurance. It is a legitimate expense, especially in your situation. Your lawyer should be able to fight for you on that one.
