    HOA and Chap 7/Foreclosure

    We filed for Chap 7 in November 2009.
    In December 2009 the mortgage comp went to court to lift the automatic stay and begin foreclosure. We surrendered the home and did not reaffirm the loan.
    We discharged March 2, 2010. We moved out Feb 2010.

    In the meantime the HOA has been billing us the yearly dues for 2010, as well as legal fees because we are in foreclosure, late fees, and $35 for each letter they send us.

    We received a letter from a lawyer stating we must pay the doubled HOA dues and fees by July 23 or they will go after us, and the bill will go over $1500.....(we did not include this in the chap 7, as we had no bill and we truly thought all things pertaining to house would be covered -- stupid I know, our fault)....BUT....isn't this dues associated with the house and not us?

    Do we have to pay this? Our home is still in foreclosure, the mortgage company sold our loan to another company. They still have not taken possession but it is theirs and they know it.

    And then if we do owe it, and the foreclosure does not go through by 2011...what is to stop them from charging us the dues for next year...this is RIDICULOUS!

    Do we owe this money? Anyone know?

    Unfortunately until your name comes off the title to the house you are liable for those HOA dues, taxes and other associated costs.
