    Converting to Ch 7 from 13

    Well, my husband got laid off (again) last week. My Ch 13 was filed on 5/28 and my 341 was 6/23 but not yet confirmed. Hubby had gone back to work 4/13 after a 15 month lay off and with his higher salary( not UE income), it prevented me from filing Ch 7.

    Met with my atty 7/14(today) and will be converting to Ch 7! Atty said we need to "strike while tbe iron is hot" and maybe the layoff was a 'blessingin disguise'. I think he may be right!

    My ch 13 pmts were $1353/month on 88K credit card debt. Aint no way I can make that pymt with hubby laid off yet again. So Now onto Ch 7 dealings!!

    I think your attorney is right - the layoff may be a blessing.
    Get rid of the CC debt, and find a new job after that

      Congrats. Looks like you dodged a bullet. That was a hefty payback amount.

        We're in a very similar situation...filed Ch13 on 5/26 and had our 341 on 6/30, but not yet confirmed. Our Ch13 payments were $1400. DH has just lost his unemployment, which paid just under $1400/month, so our disposable income is now into the negative numbers. Even though my income alone is over median, we met with our attorney today and he thinks we have a good shot at converting to a Ch7. Got my fingers and toes crossed...hope everything goes smoothly for you!
