    Can a Creditor request to see copies of Bank Statements, Payment Stubs, and other Financial Documents before the 341 meeting? Or after?

    Do they generally request them from the Trustee or Through the Attorney?

    not impossible but very unlikely

      I would think not - first, your petition with all of the information is public record, so they can just look at a bunch of stuff (including the last 60 days of paystubs). Second, why would they want to? There should be an automatic stay in place that prevents them from collecting at this time.

      The one instance I could think of would be if a person was doing a deed in lieu of foreclosure (why they would do it in the middle of a filing I don't know) or a short sale (with the bankruptcy court's permission) then often the lender asks for financial documents.

      I certainly wouldn't worry about this happening if that is really your question.

        "Request"? Let them request all they want, and let them pound sand........

        It is possible if they do an interrogatory thru the court systems, however you don't give anyone anything without being compelled to by a judge.

          The do have the right to your most recent tax return.

          But to get additional information, they would need to make a request through the BK court and have a reason. Generally, doing so would be in the context of an Adversary Proceeding. However, they can view your petition and ask you questions at the 341 meeting if they want (they rarely show up).

          The trustee and the US trustee, on the other hand, can pretty much ask for anything they want and if you don't cooperate, your case can be dismissed.
