    Report of No Distribution,question

    Sorry if this has been asked before but I'm confused.
    I checked pacer today and saw Trustee's Report of No Distribution dated 07/09/10. Had 341 on 06/10/10 I assume this mean I'm a no asset case
    (my attorney had said he thought I would be an asset case). If I am a no asset case can I sell anything now? Also received my tax return ($2,200.00)
    on 06/21/10. At my 341 meeting the trustee never question me about it or told me not to cash it like the people before me, so does this mean I can keep it? I really need money to buy groceries, tires and pay auto insurance.
    Also is discharge 60 days from 341 or Trustee's Report of No Distribution

    Pick up the phone and call your attorney tomorrow. Since he originally said he thought you would be an asset case I would want to ask about the "no distribution" that you are seeing. Double check with the attorney. Quite possibly the trustee doesn't want to bother with whatever it is that your attorney thought he would want.

    As far as selling an asset before discharge that is something I would be careful about and only proceed upon your attorneys advice.

    Discharge is normally 60 days from your 341.

        Then call Tuesday. I wouldn't take the chance of selling an asset right now.
