    trying means test...

    Is there somewhere that explains what exactly to input in this form on legalconsumer.com?
    For example: I am filing alone and on line 53 it asks for amount of total non-priority unsecured debt. Is that MINE or the household?
    And a not related to means test question... : )
    If I only deposited my tax refunds at the end of May am I better off waiting to file in November or can I get the process going now?

    If you are the only one filing then only your debt is listed. As far as your tax refund I'm sure you've already spent that correct? It shouldn't be an issue unless it was a very large amount of money and you still have cash in your bank account. If you do, then try and find a way to exempt it.

      ok thanks for the reply. The refund was a little over $5K and yes It is long gone. The means test puts us way over median but way negative for DMI due to high mtg and these debts. I do not work so the household income is strictly from my husband would they not include HIS debts in the calculation if we were + for DMI? Because if it is just my non secured debts how would his get paid if we/I was forced into a chap 13. Does that make sense?

        Even when filing singly the household income is taken in to account. On the flip side, your husbands expenses can all be counted as expenses (including his unsecured debt payments.) My 2 cents: You should have a good attorney draw this up for you. It sounds like you're trying it alone, and with household income being over the median you are not going to have an easy slam dunk Chapter 7.

          yeah no I know my case is complex. I have an attorney I just haven't retained him yet. And basically the means test cost is the retainer deposit fee so I wanted to see how close it would be on the means test if I input the info myself. I feel less stressed about money now that I feel I may have a good shot at chap. 7. I have a few young children and I have stressed about money all their lives I don't want them to inherit the same feelings I have so I need to do something about it. We had a failed business in the last few years so that really catapulted this whole thing.
