Filed for chapt 7 day after.. Lol

    Filed for chapt 7 day after.. Lol

    Hey there:

    I am curious to see. Well I did file for chapt 7 at the beginning of the month; a day after i received a letter from the apt complex saying they were sending me to eviction. Anyways; i filed the paperwork went to the office to inform them about it and the assistant manager put up a fight. She claims they filed my paperwork before i filed; well I informed her that they never filed it with the court and i found out via the properties lawyer.


    I wonder how long its going to take. LOL! I am so happy i got to file before they did - i am fighting it regardless. the rent her is $680 a month + Everything; been here for 3 years (4th would have been next month). They dont even assist.

    OH WELL!

    Remember your filing only helps you out with your rent owed UP UNTIL YOU FILED. anything after your filing date you are responsible for and it is NOT DISCHARGEABLE.

        It would not have mattered who got their papers in before the other. Once you filed, they cannot evict or sue you for eviction. However the others are correct, you must then pay the rent as if you get too far behind in the "new debt" the landlord then could have cause to ask for lift of stay and toss you out. 'Hub


        Edit: P. S. make sure they date your receipt for the current month and not the back months.
