    Summons - now a court date.

    I received a summons and was told that I needed to appear
    in Civil Court. I went today and they made a court date for Sept.

    Question - can the bank that is suing me freeze my bank account yet?

    Do they have to wait until after the hearing?

    I plan on filing Chapter 7 in about a month.

    As long as the debt isn't to the bank in which you keep your money,you'll be fine. They would have to win their lawsuit first, then receive a judgment.

      Newbie2 is correct. Are you attempting to file before that Court date? What is the amount as if it is small claims you are likely to get a judgment against you. You don't want that extra trouble. File before that Court date and your "suggestion of bankruptcy" will stop that action. 'Hub

        Yes. Around August.

        It's $18,000.00.

        Aside from garnishing wages and freezing the bank account, is there
        anything else that could be bad or harmful that I should know about?

          They could file a lien against real property that you own.

            I don't own a home, and my car is 20 years old.
