    finance company worker came to my house..m

    I am scheduled to officially file on July 1st, have already had initial consult with lawyer whom told me to not bother with notifying this finance company unless I really wanted to, they'd find out soon enough.

    My van payment(the reason i owe the finance company) was due on May 15th, I didnt pay it,and was due again on June 15th which I again did not pay it.. they have called 3 times from the office number,but I have also gotten calls from a 877 number that I dont know who is, maybe its them?? either way I have ignored them all, messages were left when they called from the actual OFFICE.. anyway..

    this evening a lady from the finance office showed up at my house. wanted me to pay her half of my late balance, or to agree to come into the office to re-work the loan. I told her the vehicle had about $4000 worth of repairs it needs(transmission is out of it again, front main seal is leaking,and water pump is leaking) and that I had no interest in re-working the loan. that I had a appt next week with a bk lawyer and was probably going to go that route(tho I AM going that route I wasnt sure what I should say to her).. she went on and on about how we can work something out, how we can re-work the loan, isnt there someone you can borrow the money from.. "we can work this out".. I insisted that would be pointless,as the van still would be un-usable and I had no funds to fix it and was STILL going to be filing BK and would be senseless for me to keep the non working in need of pricey repairs van..

    she mentioned at one point that her boss may want to just take the vehicle. I told her that I couldnt stop them from doing so, it is no use of me torn up anyway.

    then she continued to go on and on about working something out.. is going to let me sleep on it, see if I can figure out a way to borrow the money, decide to re-work the loan. she'll call me tomorrow,please answer.

    I mean really? how many hints do some people need..

    and since when do they make freaking house calls?

    I cant believe credit companies are sending people out to make house calls now for collections. Just shows how desperate they are getting. Its sad really. We are all having a tough time.

      Yes, what some creditors will do is surprising...almost shocking. A few months ago I had a rep from my second mortgage show up announced at my door wanting to "help me work things out"....!!!

        I keep hearing that more and more creditors are coming out to customers houses now. I understand that it is mostly the smaller loan places. I would have only said it once and then asked her to leave my property. if she refuses to leave you have the right to call the police and have her escorted off the property. You may even want to post a no trespassing sign. If anyone comes on to your property without your premission then they can be sited for tresspassing.

        Also big dogs do the trick. I have had people come up to my house trying to sell stuff and I just let my 3 dogs bark. It is funny to watch them get out of their car and turn right around and go back into their car when they see my dogs barking. I have to admit I do get a good laugh when that happens.

          Well, she's trying to get you to see it her way, but the van might fall apart before too long. You can work it out.

          If the van is totally undriveable, then there is no point in refinancing. However, if the van is salvageable, you may want to try to get them down to a really low note at a low interest rate. Really drive a hard bargain, like a refinance to 3.9% for another 5 years - and with any late penalties you have been assessed removed. They know that the car is worthless and you are going to be filing Chapter 7, so anything from you would be something.
