    Our lawyer in the begining said we were fine for chpt 7 now she said we may want to go over our numbers because we do not qualify for this instead a chpt 13. I have a few questions. On the Schedule J form me and my husband are going over the items and we both realised we really put low amounts on some of them. Our questions are where do we put the items like pet supplies/grooming..holiday expenses..inspections and registration would that be under transportation? Is the gas also supposed to be under the transportation? we are close to filing if we can get this to come out right and would love some help. Thank you in advance.

    I am doing a search of the boards and it looks like I can file this info on line 17 although I am not quite sure? Any help would be great I need to get this to the lawyer today and Im a mess

      Your pet supplies would go in a miscellaneous category, just make sure you don't claim too high of an amount. Holiday expenses would go under gifts, your transportation expenses (registration, inpsections, gas, etc) would all go under transportation.

      Don't worry so much about making an expense fit a line in the forms. You can take a list to your attorney and they will make sure it goes on the proper line.

        thank you so much for responding. I did not do the search right the first time and found loads of info. Do you think if I get the list together and post it here I can get some advice on it before submitting to the lawyer?

            electric and fuel: 250
            Telephone (cell) 126
            home maintenance 100
            food: 700
            laundry: 50
            medical/dental 100
            transportation 425 (that is no car payment just gas and maintenance)
            recreation: 200.

            avg monthly income 4167.38

            what do you think?

            auto insurance 200.

              Everything looks good with the exception of recreation. You don't state how many are in your family, so that's a hard one to judge (if it's too high)

              Also, you have nothing for clothing. Ditto on water / sewage bill, and cable.

              If there are 2 of you, you are allowed $60 per person for medical. Also ask your attorney if you can take an ownership expense for your vehicle/s. In many districts you can claim both ownership AND operating expenses even if you don't have a car payment.

              One last hint: Go through your bank statements and make notes of everything you have spent money on. You may pick up on one or two things that you haven't considered yet.

              You still have left over disposable income, so you really want to make sure you are listing each and every expense that you can.

                ok lets see we are a family of 4
                in RI

                clothing is 100
                hair dressers 100
                water is well water
                cable internet is 150. a month

                and medical we just have a copay so those are just rx monthly. Thanks so much for helping me with this.

                  Gotcha! See, you found more expenses :-) Add in your clothing, personal grooming, and cable/internet.

                  For your medical, make sure you add in non-prescription items: Vitamins, etc that you routinely purchase for your family. Even $20 a month can help a lot!

                  As for your well, do you ever buy filters or such for water treatment?

                    omg you are brilliant! LOL

                    no we don't add anything on the water treatment. I panicked she said we were over 800 dollars the first time around and we would have to file chpt 13 but now if I do this we should be good right? when Im listing this do I list it as other expenses on a separte sheet and she can add it?

                      I would just make sure it was listed somewhere, and the attorney would know if it should go in to utilities or miscellaneous. I didn't do the calculations of your income / expenses, but it sounds like you have a good handle on true expenses now. (Wish we had done that, we have been in a Chapter 13 now for 4 years and probably didn't need to be. Hindsight...and not finding this forum are the culprits :-)

                      Whatever you do, go over the forms completely before you sign anything. Make sure nothing was left off. Good luck!

                              Many people end up with a negative amount for a Chapter 7. Good luck!
