Need advice-file chapt 7 or cont. To do nothing

Nov 09 was the last payment to my credit cards. I'm about 9,000 in cc debt and owe 15,000 on my car. I receive disability pension from my former employer and get SS disability. I went to a lawyer and she said If I want to file chapter 7 OK and gave me her fee.
Can anyone give advice? I do have debt but sometimes I wonder if I should just try to make a settlement with them and make payments . anyone?

9K and 15K is not a lot of debt to try and settle on. I would see what settlement offers you could get. Your SS should not be able to be touched by any garnishments and I believe your disability is also judgement proof. Personally I would not consider BK on this amount of debt.

I have not received any settlement offers yet. I dont know if they will do that or try to sue me. I just keep getting bills from them. at first I got calls all day every day, but it has pretty much stopped

How late are you on everything? Sometimes it takes a year before settlement offers will start.

You can wait and see what comes in or you can contact the creditor to see if they are able to offer any settlements. Normally the creditor will have a couple of options, some will not offer any settlements. It depends on who the creditor is.

About a year and a half before I filed my BK I actually started closing accounts and trying to do settlement offers. I got some down to only paying 50% of the debt.
