    Pitney Bowes Lease ???

    I have a Pitney Bowes lease for a postage machine for my small business. I have been trying to get out of it. I can't afford it now and haven't used it in months. I'm planning to file sometime soon..depends on the loan modification I'm talking to BofA about. My question is, can I include this postage meter in my bankruptcy? It seems to be the only possible way to get rid of this. Now they say the account is going to collections. Is there any way to get rid of this lease without bankruptcy?

    You'll need to contact Pitney Bowes Customer Service and ask them. Explain the situation and they'll tell you what you need to do.

      I got rid of my pitney bowes after my bk. I had a credit line and the machine. I filed personal 7. It took them awhile to stop calling and I had to keep giving them my lawyers info in regards to the line of credit.

      As for the machine, I called them and told them I filed bk and was closing down my business. I was able to send it back no problem.

      However, they were the one place that sent me a 1099 (thus making my taxes a pain to figure out)

        Did you include Pitney Bowes in the list of leased items in your bankruptcy? I just want them to take the machine back. They are such a pain. Their suggestion was for me to find another company to take over the lease. A lot of businesses don't use this anymore because of postage from
        the post office and computers.

          I have been trying to get Pitney Bowes to cancel my lease and take back their machine. They have been calling daily and now I received a box from Pitney Bowes a couple of days ago. Does this cancel the lease which is what I wanted them to do or is this a repo?? I didn't receive any documentation with it, just a return lable. If it is a repo, what happens when I do file bankruptcy?
          I'm still not ready to file because I'm still trying for a loan mod and have now missed May & June Payment. The modification has been escalated by the CEO of home loans to a negotiator so.. hopefully I'll hear back soon. I was planning on a Chapter 7 when I was still current, now I don't know what to do. I'm totally messed up now and scared. Any suggestions, anyone???

            From what I am reading, it appears the postage meter lease would be an executory contract. If you decide to go with a Chapter 7, my understanding is that you would simply reject the lease.
