    Question regarding motion to lift stay

    If you look at my previous post you see that we are one mortgage payment behind. The hearing is set for July 7th. If we get current by June 30th (which we will), then what happens? Does the hearing get dismissed?

      There may not be enough time between when you become current & the hearing date. You may have to appear at the hearing, bringing with you all the documentation that you have to prove that the mortgage is current.

        Even though you may now be current they will still probably be granted there motion. They may just want to lift stay so they can contact you about your loan or they may not even do anything once the stay is lifted if your current.

        In our case we are current but surrendering our home. WF has filed for relief from stay, so I expect that maybe they just want to ask if we would like to modify and keep the home or they just may want to go ahead and foreclose even though we haven't defaulted yet.
