We met with our atty over the weekend to sign the petition, we also did the credit counseling on line and over the phone phone as well. Certificates were emailed to us and our atty. Hope to be filed on Friday. I will feel much better though once the hearing and discharge is done so we can move on with our lives and start over. We are keeping the house, not reaffirming though as suggested by our atty, (but knowing our luck there will be a glitch and we'll have to reaffirm it.) I am not planning on going anywhere anyways for 5-10 years, kids are young and still in school. We are underwater, who isn't, but I don't look at a home as a investment, its a home.

Finally getting filed

Congrats on the progress. We are a few months post discharge and things are finally starting to look up. We did not reaffirm our house (have equity and very small payment) and are relocating to another area. We are renting out the home now and it is generating positive cash flow for us. We did have a rental property that was foreclosed, but it was underwater by more than $200K and was a monthly drain. What a relief. We've been maintaining two households since August of last year and we are now going to be able to reunite the family and cut $2K of monthly expenses! WooHoo!
Now to get some of our discharged debts paid off. Our doctor was very understanding during our years of distress and continued to see us, even through all of the times we were uninsured. He's first on the list. (if some of our other creditors were as flexible we might have similar feelings for them, oh well, too bad Chase and Wells Fargo.)
My state of mind compared to this time last year is 100% improved. The pain will recede and hope and opportunity will return. Hang in there.Case Closed > 2/08/2010

Most our delay in filing has been the loan mod from our mortgage company, that became final a few months ago. A year ago and up until a few months ago, we were getting calls daily, we not only did want to answer the phone, but did not want to even be home to hear it ring. Filing will not give us extra money, it will eliminate the vicious cycle. A year ago at this time is when thing really started to fall apart when my hours were cut. I lost a days pay every two weeks. I may not sound like alot, but every little bit counts. When the hour were reinstated in September, I was laid off in October only to take a job that I was making less money and no benefits. We always paid our bills on time, cars, house, credits cards, etc. To not make a house payment, or the car payment was like a big no no. But you talk to others not only on this website, but in general, you have to do what you have to do. Honenstly, the longer we waited the better I begin to feel about our decision. I have read here filing is a cake walk compared to going through a loan mod. I hope thats true. I will keep everyone posted.
