I would recommend filing before you start work, unless you could work out debt reduction plans with your creditors based on your new ability to pay. If you file now, you can then honestly complete your schedules I and J using your current numbers. You will likely be asked about anticipated changes in your income at your 341, but I would answer that by saying that I anticipate getting some work as a short term independent contractor.
Chances are that you will get through the process without a hitch.
So what are the downsides? Worst case is that they claim abuse and try to force you into a 100% Chapter 13 or deny the discharge altogether. What have you lost in this case? Your filing fee and attorney's fees and you have the bankruptcy on your credit file without getting the benefit of a Chapter 7 discharge.
If they do try to force the 13, you could probably drag it out until your contract term ends, in which case you wouldn't have the funds to support a 13. Alternatively, they force the 13 and your contract ends, you could then try to convert to a 7 based on the loss of income.
Good luck (and congratulations on the contract job!)Case Closed > 2/08/2010

You should not have been actively looking for work if you were considering BK.Filed: 6-7-2010 341: 7-15-2010 DISCHARGED: 9/17/2010

To the OP,
First off, congratulations on getting a contract job! I suggest you discuss this with a bk attorney if you have hired one regarding your new upcoming income and how it would affect your bk case if you were to file immediately. It might be hard to settle with the creditors especially if you are going to have short term income without filling for bk. Hopefully your new job will turn out more permanent for you.
Good luck!Chapter 13 filer since Feb. 2018 under a 60 months payment plan
Please think positive and do not give up!

And where on earth did you come up with that line about not looking for work if you are planning on filing bankruptcy? You're supposed to just sit there and wallow in self pity? Come on.Case Closed > 2/08/2010
